Article 1 - General Provisions

1. By browsing this area, the user accesses Sommelier Academy, accessible through the URL: sommelier.academy. Browsing and submitting a purchase order on the site implies acceptance of the Terms and Data Protection Policies adopted by the site as indicated therein.

2. These General Terms and Conditions of Sale apply to the sale of goods and the provision of services exclusively for purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by:

3. The user is required, before accessing the products and services provided by the site, to read these General Terms and Conditions of Sale, which are considered generally and unequivocally accepted at the time of purchase.

4. The user is invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which Sommelier Academy reserves the right to unilaterally modify without notice.

Article 2 - Object

1. These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for goods and services on Sommelier Academy and do not apply to the provision of services or the sale of products by entities other than the seller that are present on the same site via links, banners, or other hypertextual connections.

2. Before submitting orders and purchasing products and services from third parties, we recommend checking their terms and conditions of sale.

Article 3 - Conclusion of the Contract

1. To conclude the purchase contract, it is necessary to complete the electronic form and submit it following the related instructions.

2. It contains a reference to the General Terms and Conditions of Sale, information on each service purchased, images of each product, its price, payment methods available, delivery methods for the purchased products and related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, methods, and times for returning the purchased products. The seller is not responsible for any inadequacy in the graphical representations of the products shown if due to technical reasons, as the representations are purely illustrative.

3. Before completing the contract, the user will be asked to confirm that they have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data.

4. The contract is concluded when the seller receives the completed form from the user, after verifying the correctness of the data contained therein.

5. The user will be required to pay the price once the online order submission procedure is completed. This will occur by clicking the "Buy the course" button at the end of the guided process.

6. Once the contract is concluded, the seller will process the order for fulfillment.

Article 4 - Registered Users

1. In completing the registration procedures, the user agrees to follow the instructions on the site and to provide their personal data correctly and truthfully.

2. During the purchase procedure for the wine-box in the tasting courses, the user confirms they are over 18 years of age and have the legal age required to purchase alcoholic beverages.

3. The confirmation will relieve Sommelier Academy of any responsibility regarding the data provided by the user. The user agrees to promptly inform Sommelier Academy of any changes to their data communicated at any time.

4. If the user provides incorrect or incomplete data, or if there is a dispute from third parties regarding payments made, Sommelier Academy may choose not to activate or suspend the service until the related issues are resolved.

5. Upon the first request for the activation of a profile by the user, Sommelier Academy will assign them a username and a password. The user acknowledges that these identifiers constitute the validation system for accessing the Services, and the actions performed through this access will be attributed to them and will have binding effect on them.

6. The user agrees to keep their access data confidential and to store them with due care and diligence, and not to disclose them, even temporarily, to third parties.

Article 5 - Product Availability

1. Product availability refers to the actual availability at the time the user places the order. However, this availability should be considered purely indicative, as, due to the simultaneous presence of multiple users on the site, products may be sold to other customers before the order is confirmed.

2. Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically amended by removing the unavailable product, and the user will be immediately informed via email.

3. If the user requests the cancellation of the order, thereby resolving the contract, Sommelier Academy will refund the amount paid within 30 days from the time Sommelier Academy becomes aware of the buyer's decision to resolve the contract.

Article 7 - Payment Methods and Prices

1. The price of the products and services will be the price indicated from time to time on the site, unless there is an obvious error.

2. In case of error, Sommelier Academy will notify the buyer as soon as possible, allowing them to confirm the order at the correct amount or cancel it. Sommelier Academy will not be obliged to provide the goods at the wrongly indicated lower price.

3. Prices on the site include VAT and shipping costs. Prices may change at any time. Changes do not affect orders for which an order confirmation has already been sent.

4. Once the desired products and services are selected, they will be added to the cart. It is sufficient to follow the instructions for purchasing, entering or verifying the required information at each step of the process. Order details can be modified before payment.

PayPal; Credit Card (Aura, American Express, MasterCard, Visa, and Visa Electron)

Article 8 - Delivery

1. The company DaFrom S.r.l. organizes and manages the shipping of the wine-boxes on behalf of Sommelier Academy.

2. Sommelier Academy ships throughout Italy, excluding Vatican City and the Republic of San Marino.

3. Sommelier Academy will only deliver to the user's address provided at the time of purchase.

4. Delivery is generally made within 5-7 days, or, if no delivery date is specified, within the estimated time at the time the delivery method is selected, and in any case, within a maximum of thirty days from the confirmation date.

5. If delivery cannot take place, the order will be sent to the depot. In this case, a notice will indicate the location of the order and how to arrange a new delivery.

6. If the user cannot be present at the delivery location at the scheduled time, we ask them to contact us again to agree on a new delivery date.

7. If delivery cannot take place for reasons not attributable to us, after thirty days from the date the order is available for delivery, we will assume the contract is resolved.

8. As a result of the contract resolution, amounts will be refunded, including delivery costs, excluding any additional costs from choosing a delivery method different from the ordinary one offered, without undue delay and in any case within 30 days of the contract resolution date. Shipping costs due to the resolution of the contract will be borne by the user.

Article 9 - Right of Withdrawal

1. The right of withdrawal applies only to products purchased on the site by consumers (i.e., individuals who purchase for purposes not related to their professional activity, or make a purchase without indicating a VAT number).

2. The right of withdrawal can be exercised within 14 days from the day of receipt of the products, following the instructions provided by Sommelier Academy.

3. To exercise the right of withdrawal, the user must notify Sommelier Academy of their decision to withdraw from the contract.

4. The product must be returned unused and in the same condition in which it was received.

5. Upon exercising the right of withdrawal, the user will receive a full refund, excluding the return shipping costs, which are borne by the user.

Article 10 - Guarantees

1. Sommelier Academy offers a guarantee on its products and services in compliance with current legislation.

2. The guarantee applies to products found to be defective or non-compliant.

Article 12 - Dispute Resolution

1. All disputes that may arise regarding the validity, interpretation, and execution of the contract are subject to Italian law and the exclusive jurisdiction of the court in the place where the consumer resides or is domiciled.
